Social Rooting: Requirements and Application Process

Social rooting is a legal figure in Spain that allows immigrants in an irregular situation to regularize their status and obtain a residence permit. This procedure is based on the applicant's connection to Spanish society, which includes factors such as the length of stay in the country and the existence of family or social ties. Below are the requirements and the application process.

Requirements for Social Rooting

To apply for social rooting, it is necessary to meet the following requirements:

  1. Residence in Spain: The applicant must have resided in Spain continuously for at least three years. This time must be duly accredited, and any interruption may affect the application.

  2. Social ties: It is imperative to demonstrate the existence of ties to Spanish society. This may include, among others:

  3. Having direct relatives who are Spanish citizens or legal residents in the country.
  4. Having a valid employment contract or a job offer.

  5. No criminal record: The applicant must not have a criminal record in Spain or their country of origin. This is verified by presenting a criminal record certificate.

  6. Economic means: It is necessary to demonstrate that there are sufficient means to support oneself and, if applicable, to support any family members under their care.

  7. Not being in an irregular situation: The applicant must not have been expelled from Spain in the last 10 years nor be in an expulsion process.

Application Process for Social Rooting

The application process for social rooting is carried out in several stages:

1. Preparation of Documentation

The first step is to gather the necessary documentation, which includes:
- Valid passport or identity document.
- Certificates proving residence in Spain for at least three years.
- Documents demonstrating family or social ties.
- Criminal record certificates.
- Proof of economic means.

2. Submission of the Application

Once the documentation is gathered, the applicant must submit the application at the Foreigners Office corresponding to their place of residence. The application is submitted using the EX-10 form, along with the required documentation.

3. Resolution of the Application

The Foreigners Office will evaluate the documentation submitted and, within approximately three months, will issue a resolution. If the application is approved, a one-year residence permit will be granted, which can be renewed later.

4. Obtaining the NIE

Once social rooting is granted, the applicant must obtain the Foreign Identification Number (NIE), which is necessary to carry out any administrative procedures in Spain.

Conclusion

Social rooting is an effective way for immigrants in irregular situations to regularize their stay in Spain. Meeting the established requirements and properly following the application process is essential to obtaining the residence permit.
