Comparison of Different Types of residency

Spanish immigration law includes various forms of residency that allow foreigners to regularize their status in the country. Each type of residency has specific characteristics and requirements that must be met. In this article, we will analyze the differences between the types of residency: social residency, family residency, and labor residency.

Social residency

Social residency is a modality that allows foreigners who have lived continuously in Spain for at least three years to regularize their status. The main requirements are:

  • Residence: Demonstrating continuous stay in Spain for three years.
  • Family or social ties: Presenting a social integration report that proves the existence of ties with Spanish society or with Spanish citizens.
  • Economic means: Justifying that one has sufficient economic resources to live in Spain.

Social residency is particularly used by those who intend to settle long-term in the country and contribute to society.

Family residency

Family residency is an option for those foreigners who are relatives of a Spanish citizen or a legal resident in Spain. The requirements are:

  • Family bond: Being a spouse, de facto partner, ascendant, or descendant of a Spanish citizen or resident.
  • Residence: No prior residence period in Spain is required, but the family relationship must be verified.
  • Economic means: Justifying the economic capacity to support the family in Spain.

This type of residency facilitates the regularization of foreigners who have family ties with Spanish citizens, promoting family unity.

Labor residency

Labor residency is a modality that allows regularizing the situation of foreigners who have worked in Spain irregularly for at least six months. The requirements include:

  • Previous work: Proving that one has worked in Spain for at least six months in the last two years.
  • Employment contract: Obtaining a work contract from an employer willing to regularize the worker's situation.
  • Economic means: Ensuring that one has sufficient resources to maintain residency in Spain.

Labor residency is an option for those who, despite having been in an irregular situation, have demonstrated their employment capability in the country.

Comparison

Type of Residency Minimum Residence Required Ties Employment Contract
Social residency 3 years Social or family No
Family residency Not applicable Family No
Labor residency 6 months Not applicable Yes

The choice of residency type will depend on the personal situation and ties of each individual in Spain. It is important to evaluate the conditions and requirements to choose the modality that best fits each case.
