How to Prove Cohabitation for a Civil Partnership if One Partner Was in an Irregular Situation

How to Prove Cohabitation for a Civil Partnership if One Partner Was in an Irregular Situation

Navigating Spanish immigration law can be complex, especially when applying for residency as the family member of an EU citizen through a civil partnership (pareja de hecho). A common challenge arises when one partner has been in an irregular immigration status, making it difficult to provide standard proof of cohabitation. This article explains how to demonstrate your relationship effectively under these circumstances.

The Legal Requirement: One Year of Cohabitation

Spanish regulations for unregistered civil partnerships (pareja estable) require demonstrating a continuous, marital-like cohabitation period of at least one uninterrupted year. This is the primary condition for the relationship to be considered valid for immigration purposes.

The only exception to this one-year rule is if the couple has a child in common. In that case, you only need to prove a stable cohabitation, without the strict one-year minimum.

Proving Cohabitation When One Partner is Irregular

The main difficulty for couples where one person has an irregular status is the lack of official documents. However, it is not an insurmountable obstacle. The key is to build a robust case with various forms of evidence.

Standard Forms of Proof

These are the most direct and powerful documents, though they may be hard to obtain in this situation:

  • Joint Municipal Registration (Empadronamiento conjunto): This is the strongest evidence. While challenging, some municipalities in Spain allow registration even without a valid residence permit. You should always inquire at your local town hall (Ayuntamiento).
  • Joint Rental Agreement: Having both names on the lease for the shared home is excellent proof.
  • Joint Bank Accounts: A shared bank account used for common expenses demonstrates a shared life and financial commitment.

Alternative and Complementary Evidence

If you lack the official documents above, you must gather a wide range of alternative proofs to substantiate your relationship over the required one-year period. The goal is to create a comprehensive file that leaves no doubt about the authenticity and duration of your cohabitation. Consider including:

  • Individual Empadronamiento: If a joint registration isn't possible, both partners being registered at the same address, even with different registration dates, can still be valuable.
  • Witness Statements: Notarized statements from friends, family, or neighbors who can attest to your relationship and cohabitation.
  • Photographs: A timeline of photos together over the past year in different situations and places.
  • Travel Documents: Plane tickets, hotel reservations, or car rental agreements from trips taken together.
  • Financial Documents: Evidence of money transfers between partners, or utility bills for the shared home (even if only in one name).
  • Social Proof: Any other evidence showing a public relationship, such as social media interactions, invitations to events as a couple, or correspondence addressed to both at the same address.

Ultimately, immigration officials will evaluate the case as a whole. The more consistent and varied your evidence, the stronger your application will be.
